I. INTRODUCTION
This matter comes before the Court on cross motions for summary judgment. Plaintiffs, led by Yakima Dixie, claim to be members of the California Valley Miwok Tribe (the “Tribe”). They challenge the August 31, 2011 final decision of Larry Echo Hawk, the Assistant Secretary of the Bureau of Indian Affairs (“BIA”) of the United States Department of Interior (“DOI”). Dkt.
