Michael D. Houston, Sr., was convicted of intentional second-degree murder for shooting Joshua Johnson and received a sentence of 165 months’ imprisonment. He appealed, and the Court of Appeals affirmed. State v. Houston, No. 98,373, unpublished opinion filed September 5,2008. We granted Houston’s petition for review under K.S.A. 60-2101(b).
