The background of this discrimination action brought against the Unemployment Insurance Appeal Board of the State of New York (the “Board”) and the New York State Department of Labor (together, “defendants”) is set forth in two opinions reported at 683 F.Supp. 353 (S.D.N.Y.1988) and 89 F.R.D. 382 (S.D.N.Y.1981), and a third, unpublished opinion, No. 79 Civ. 5831 (S.D.N.Y.
