This is an original action, in quo warranto filed in this court by F. E. Cherrington, as prosecuting attorney of Gallia county, Ohio, seeking to test the legality of the existence of the municipal court of the city of G-allipolis, and the right of the defendant, John 'C. Hutsinpiller, to exercise judicial authority as judge of such municipal court.
