So deeply impressed am I with the sense that the defendants, especially some of them, wer.e wrongfully convicted, that I cannot consent to an affirmance of the judgments. It may not avail to relieve them of the disgrace put upon them, but it is due to them, and to myself in differing from my Associates of equal sincerity, that I should state the grounds of dissent, as briefly as the multitude of facts and questions of law involved will permit.

The glory of the criminal law and the aspiration of its ministers should be to accord to the accused, as far as possible, a fair and impartial trial. He…
