The plaintiff in error, hereinafter called defendant, was informed against for murder in the superior court of Okmulgee county, convicted of manslaughter in the first degree, and sentenced to the state penitentiary for a term of 15 years.
The record discloses a state of facts about as follows: The deceased, Floyd Williamson, had married a sister of the defendant about 3 years prior to the homicide.
