Plaintiff James Horton filed this action to recover for personal injuries suffered when he was thrown from his motorcycle after striking a large hole in a city street. Following a jury trial, a verdict was entered for $50,000 against both the City of Ottawa and Marseilles Plumbing and Heating Company which had torn up the street for private sewer work several years earlier.
