Plaintiff, Eugene Kottmeyer, filed a two-count complaint in the circuit court of St. Clair County against the defendant, Consolidated Rail Corporation, seeking recovery for injuries alleged to have been sustained in a fall on August 29,1976. Count I asserted negligence under the Federal Employers’ Liability Act (45 U.S.C. §§51-60 (1976)); and it was there alleged that at the time of his injury, plaintiff was employed by the defendant for purposes of the Federal Employers’ Liability Act (hereinafter FELA).
