Appeal by the defendant, The Order of United Commercial Travelers of America, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of New York on the 25th day of January, 1915, upon the verdict of a jury, and also from an order entered in said clerk’s office on the 22d day of January, 1915, denying the defendant’s motion for a new trial made upon the minutes.

Clarke, J.:
This action is to recover from defendant, a foreign fraternal insurance corporation duly authorized to do business in this State, the amount payable, under its constitution and by-laws, for the death of plaintiff’s decedent, Andreas A. Basse, claimed to have been caused solely by an accident. It was conceded that the decedent at the time of his death was a member in good *748standing in the order.
