First National Bank of California, Pa. Assumpsit to recover the proceeds of a check. Before Taylor, J. The facts appear by the opinion of the Supreme Court. Verdict and judgment for defendant. Plaintiff appealed. Error assigned was in refusing binding instructions for plaintiff.

The Monongahela National Bank of Brownsville, plaintiff, on November 7 or 8, 1907, transmitted to the First National Bank of California, defendant, for collection, from the People’s Bank of California, a check of which the following is a copy:

“ Five Thousand Dollars
“Cashier’s Check
“ O. F. Piper, Cashier
