In an action for conversion defendant has appealed from an order overruling a demurrer.
The allegations of the complaint, necessary to be stated, are substantially: That plaintiff, on November 22nd, 1921, was the owner of, and entitled to the possession of, certain personal property under, and by virtue of, two chattel mortgages made by the Rex Theatre Company to plaintiff; that one mortgage, dated May 3d, 1920, secured one note for *532$803.12 dated March 27th, 1920, due and payable on demand, with interest at 10 per cent per annum, no part of which has been paid; that…
