DECISION AND ORDER
MARRERO, Judge.
Pro se plaintiff Michael Melnitzky’s (“Melnitzky”) initiated this action alleging fraud and breach of contract; defamation; conspiracy to obtain services and avoid payment; and prima facie tort. Defendant Robert Rose (“Rose”) moved to dismiss the complaint pursuant to Federal Rule of Civil Procedure 12(b)(6) for failure to state a cause of action upon which relief could be granted.
