On May 28, 1942, the plaintiff, Louis Dewenter, entered into an agreement with John Mott, the defendant, to purchase from him, for the sum of $1,800 cash, a certain piece of real estate in the City of New Orleans described by the municipal number 3655-57 Tchoupitoulas St. The agreement was drawn and signed in the usual form, no deposit being made at the time. It contained this stipulation, "If title is good and merchantable or can be made so within a reasonable time, I agree to accept title to the above property and pay the balance of the purchase price upon passing act of sale before…
