In an action for the imposition of a constructive trust, the defendants appeal, as limited by their *414notice of appeal and brief, from stated portions of an order of the Supreme Court, Suffolk County (Cannavo, J.), dated August 9, 1993, which, inter alia, denied their motion to strike the action from the trial calendar, to vacate the note of issue, and for leave to renew their motion for summary judgment dismissing the plaintiff’s complaint.

Ordered that the order is affirmed insofar as appealed from, with costs.
