Juanita Fletcher brought this action against her former employer, the City of Houston, and her former supervisor, Susan McMillian. Fletcher asserted age discrimination claims against the City under the Texas Commission on Human Rights Act (TCHRA). TEX. LAB. CODE ANN. § 21.001 et seq. (Vernon 1996 & Supp. 2004-2005). She alleged an intentional infliction of emotional distress claim against McMillian.
