Prior to August 9,1901, plaintiff in error presented a petition to the circuit court of Cook county for leave to file an information in the nature of quo warranto against defendant in error, which was on that day allowed and the information filed, but with the understanding on the part of the court and counsel for the respective parties that the respondent should have the right thereafter to ask that the order be set aside. On the 17th of the same month a motion to that effect was duly made, and after some delay, the occasion of which is unimportant, submitted to Judge Hanecy on the petition…
