Jackie Wayne Burk appeals his conviction of sexual intercourse without consent, Section 45-5-503, Montana Code Annotated. He was tried and convicted in May 1987 in the Fourth Judicial District, Missoula County, Honorable James B. Wheelis presiding. Burk was sentenced to twenty-five years in the Montana State Prison for his conviction of sexual intercourse without consent, to run consecutively with an additional ten-year sentence imposed for use of a weapon in the commission of the offense.
