I.INTRODUCTION

This action arises out of the filing of an Abbreviated New Drug Application (“ANDA”) 1 by Dr. Reddy’s Laboratories Ltd. and Dr. Reddy’s Laboratories, Inc. (collectively, “Reddy”) to market a generic version of the antibacterial drug AVELOX ® proprietary to Bayer AG, Bayer Healthcare AG, and Bayer Pharmaceuticals Corporation (collectively, “Bayer”).
