The United States of America brought this action at the request of the Secretary of the Interior (hereinafter “the Secretary”), to recover abandoned mine reclamation fees under the provisions of the Surface Mining Control and Reclamation Act of 1977, 30 U.S.C. Section 1201 et seq. (hereinafter “the Act”), and the implementing regulations. Jurisdiction of the court is pursuant to 30 U.S.C. Section 1232(e) and 28 U.S.C. Section 1345.
