MEMORANDUM OPINION
RICHARD L. WILLIAMS, District Judge.
This case is before the court on cross-motions for summary judgment. The court has jurisdiction pursuant to 30 U.S.C. § 1232(e) and 28 U.S.C. §§ 1331 and 1345.
FACTUAL AND PROCEDURAL BACKGROUND
On November 23, 1981, the court entered a money judgment in Civil Action no. 81-0151-B (“original action”) against Ringley and Mancuso Coal Producers, a Virginia general partnership, in favor of the United States of America (“government”).
