GUITTARD, Chief Justice.

This action was brought by First National Bank in Dallas as executor under the will of Virginia L. O’Hara, deceased, to construe the provision of the will leaving a part of the residuary estate to “The Foundation for the Arts (Dallas Museum of Fine Arts).” The petition names as defendants The Foundation for the Arts and Dallas Museum of Fine Arts, which are two distinct entities, and also the decedent’s heirs at law.
