This appeal arises out of a civil action in which plaintiff Jimmy C. Britt (Britt) sought damages from defendants American Hoist & Derrick Company (AmHoist) and Ray Alden (Alden) for personal injuries allegedly sustained from defendants’ negligence. The defendants brought Miller Building Corporation (Miller) into the action as a third-party defendant, and Miller brought Goodyear Mechanical Contracting Company, Inc.
