This is an appeal on questions of law from a judgment rendered by a justice of the peace of the city of Utica in favor of the defendant. It seems that some time early in the year 1908 the plaintiff became the owner of the premises 145 Howard avenue, Utica, N. Y., and that defendant was at the time a tenant of a part of those premises. She *50was a married woman, but living apart from her husband. She continued to -reside in the premises until July, 1909, when she moved out, owing $117 rent.
