On the 21st day of February, 1913, the defendant in error filed its petition in the county court of Jackson county, which alleged that on or about the 24th day of April, 1909, judgment was rendered in the county court of Jackson county, in favor of the bank and against one William Mitchell, for the sum of $300, with interest at 12 per cent, and costs, and that on the 13th day of May, 1909, the said William Mitchell appealed said cause to the Supreme Court of this state, and that A.
