Abbott, J.:

This is an appeal from a judgment in a divorce action modifying an oral separation agreement.

Prior to the petition for divorce having been filed, the parties to the action voluntarily separated and the defendant, Anne Lewis, returned to Iowa to make her home. Before she left Kansas, the parties entered into an oral agreement whereby they provided for the custody and support of their seventeen-year-old son, divided their property, and agreed to waive alimony.
