This case was tried by the Court without jury on March 12, 1969. At the conclusion of all of the evidence, the case was argued by counsel and the case submitted to the Court for decision. The Court thereupon gave its decision from the bench upon all issues involved in the case with the single exception of the question of whether, under the language of the bill of lading involved in this case, the defendant had accepted the cargo at point of origin as being in good condition.
