This case comes here by-virtue of plaintiff’s petition to amend the sixth paragraph of his statement of claim, which reads as follows:

“6. On or about the 27th day of February, 1933, the said The Union Trust Company failed to meet its obligations in the regular course of business”; so as to read:
“6. The Union Trust Company failed to meet its obligations in the regular course of business on February 27, 1933, which has been determined as the date of The failure of the Bank to meet its obligations’ within the meaning and intendment of section 710-75 of the General Code of Ohio…
