The plaintiff, Kenneth Couture (“Couture”), filed suit against the defendants, the Town of Northbridge (“Town”) and Carlo Molinari, Inc., (“Molinari"), a contractor, for damage to his property allegedly due to a construction project in Whitinsville, Massachusetts.2 The complaint alleged claims of negligent hiring against the Town (count I), negligence against Molinari (count II), respondeat superior against the Town (count III) and private nuisance against the Town (count IV).
