Appellant filed its petition in the probate court of Tallapoosa county against appellee and other property owners, to condemn certain lands therein described for a reservoir above its dam on the Tallapoosa river. Section 7193 et seq. and section 7476 et seq., Code of 1923. Erom the valuation of the property as fixed by the commissioners appointed by the probate court, appellee appealed to the circuit court, where the cause was tried before a jury, and from the judgment there rendered the petitioner in the court below has prosecuted this appeal.
