OPINION OF THE COURT
Memorandum.
Ordered that the judgment of conviction is reversed, on the law, the accusatory instrument is dismissed, and the fine, if paid, is remitted.
In January 2011, a misdemeanor information was filed charging defendant with resisting arrest (Penal Law § 205.30), two counts of disorderly conduct (Penal Law § 240.20 [1], [6]) and harassment in the second degree (Penal Law § 240.26 [1]).
