The facts are stated in the report of the Master, which was confirmed on appeal to the Circuit Court by a formal order. The said report is as follows:

“This suit was brought by the plaintiffs for the purpose of partitioning certain real estate situated near Cross Anchor, in the lower part of Spartanburg County, and belonging to the estate of the late Frances J. Hembree. The defendant was served March 29, 1923, as is shown by the affidavit of J. B. Stribling on the reverse side of the summons and complaint. An order of reference…
