This is an appeal from a summary judgment wherein appellant, W. E. Robinson, filed suit for damages against appellee, ■City of Hereford, Texas, by reason of .alleged injuries received by appellant while he was an employee of appellee. 'The controlling questions to be determined .are whether or not appellee is immune from damages because appellant was employed and working for appellee in the •city sanitation department as a part of the city governmental function, helping to haul garbage and trash when his alleged injury occurred, and whether or not appellant failed to give…
