Error to the Court of Oyer and Terminer of Westmoreland county: Of October Term 1882, No. 112. This was an indictment against Silas S. Gray for the murder of Mary McCready. Upon the trial, before Hunter, P. J., the Commonwealth proved that Mrs. Mary McCready on and prior to February 1877 lived in a small house on the Eusldminetas river, two miles above Paulton, in Westmoreland county.

Error to the Court of Oyer and Terminer of Westmoreland county: Of October Term 1882, No. 112. This was an indictment against Silas S. Gray for the murder of Mary McCready. Upon the trial, before Hunter, P. This cause was argued here as upon a motion for a new trial, and two of the assignments of error are to the refusal of the court to grant it. We ought not to be called upon at this late day to say that it is not within the line of our recognized duties to correct supposed errors in the lower courts in this manner. Nor are capital cases an exception to this rule.
