This is the second appeal in this case. The first appeal, AllstateInsurance Co. v. Eskridge, 823 So.2d 1254 (Ala. 2001), was brought by Allstate Insurance Company (hereinafter "Allstate") from a judgment entered on a jury verdict awarding David W. Eskridge (hereinafter "Eskridge") compensatory damages on his claim of fraud. Eskridge's claim of breach of contract had also been submitted to the jury, but the jury returned a verdict in favor of Allstate as to that claim.
