Defendant-appellant Wallace Stormoen shot and killed his wife in a saloon in Idaho City on April 18, 1979. Stormoen subsequently pled guilty to a reduced charge of Second Degree Murder. At the sentencing hearing the court stated:

“[I]t is the judgment of this Court that this defendant is guilty of having committed the crime of Burglary in the Second Degree as alleged in the Amended Information on file herein. And that he should be sentenced to the Idaho State Correctional Institution under the indeterminate sentence law of the State of Idaho for a term of not to exceed…
