Plaintiff Jerry Belza,.on his own behalf and all others similarly situated, brought this collateral equity action against defendants village of Emerson, the individual members of its board of trustees, and Gerald B. Long-well, county treasurer of Dakota County. Such action sought to have • certain sewer assessments made and levied by the village against plaintiff’s real estate located therein declared to be null and void and not a lien thereon; and to obtain an injunction preventing collection thereof.
