The Plaintiff, Southbend Escan Corporation f/k/a South Bend Range Corporation (Southbend), filed its complaint in this case for breach of an insurance contract and invoked this court’s diversity jurisdiction under 28 U.S.C. § 1332. On October 15, 1985, Southbend filed a Motion for Partial Summary Judgment seeking judgment against two defendants, Federal Insurance Company (Federal) and Chubb Group of Insurance Companies (Chubb).
