This is an action to recover damages for personal injuries sustained by the plaintiff as the result of an automobile accident. The plaintiff obtained a verdict and judg*723ment for $14,800. The defendants Inland Construction Company and Harry Meek appeal.

The evidence shows that plaintiff was a civil engineer in the employ of the highway department of the state. On August 11, 1941, he was in charge of a preliminary survey being made on Highway No: 30' between Chappell and Lodgepole.
