Appeal from the Criminal District Court of Dallas. Tried below before Hon. Chas. F. Clint. Appeal from a conviction of murder in the first degree; penalty, imprisonment for life in the penitentiary. The indictment, in the first count, charged appellant with the murder of C. P. Bane, on the 3d day of December, 1900, by burning him to death, and causing him to be burnt to death with fire.

Appellant was convicted of murder in the first degree, and his punishment assessed at confinement in the penitentiary for life.
This is a companion case to that of Faulkner v. State, ante, page 311.
