Plaintiff Dennis Villano (the “plaintiff’), on behalf of his son, T.V., (collectively, the “plaintiffs”), commenced this personal injury action against defendant Kohl’s Department Stores, Inc. Plaintiff alleges that while shopping in defendant’s store, T.V. sustained an injury that resulted in a permanent scar. Plaintiff filed this action in New York State Supreme Court, alleging that the injury was caused by defendant’s negligence and demanding $500,000 in damages.
