In this case, we hold that sovereign immunity bars appellee, the Koba Institute (“Koba”), from bringing an unjust enrichment action against appellant, the Baltimore City Board of School Commissioners (“the Board”), an agency of the State. This conclusion is compelled by our recent decision in Board of Education of Worcester County v. BEKA Industries, Inc., 190 Md.App. 668, 989 A.2d 1181 (2010), cert. granted 415 Md. 38, 997 A.2d 789 (June 9, 2010) — decided after this case was argued — and by Md.Code (1984, 2009 RepLVol.), State Government (SG) Article, § 12-201.
