This is another chapter in the litigation arising from an eminent domain proceeding filed by the Missouri Pacific Railroad (Mo-Pac) in Greeley County on August 15, 1979, in accordance with K.S.A. 26-501 et seq. (Eminent Domain Procedure Act of 1963) for the “purpose of proper construction of the railroad and the security of the road in that it is necessary that plaintiff construct a dust levee as a part of and along its present right of way in Greeley…
