LOKEN, Circuit Judge.

Fredrick Newell brought this action under the False Claims Act, 31 U.S.C. §§ 3729-3733 (“FCA”), on behalf of the United States against the City of St. Paul. Newell alleged that, from 2003 through 2009, the City obtained grants from the U.S. Department of Housing and Urban Development (“HUD”) by falsely certifying compliance with Section 3 of the Housing and Urban Development Act of 1968 and its applicable regulations. See 12 U.S.C. § 1701u; 24 C.F.R. § 135 (collectively “Section 3”). The government declined to intervene in Newell’s “qui tam ” 1 action. The district court…
