MEMORANDUM OPINION

HARPER, Chief Judge.

This matter is pending before this court on plaintiff’s motion for summary judgment and defendant’s motion for summary judgment, pursuant to Rule 56 of the Federal Rules of Civil Procedure.

From the pleadings, affidavits, exhibits and briefs it appears that the plaintiff filed suit against the United States alleging in essence a breach of contract of insurance.
