MEMORANDUM OPINION AND ORDER

Defendant in this action has moved that this criminal proceeding be removed from the Municipal Court to the District Court under the federal officer removal statute, 28 U.S.C. § 1442, and that this action be dismissed. Fed. ft. Grim. Proc. 12(b) (1). Defendant, a United States Immigration Officer, is represented in this matter by the United States Attorney. The Government of the Virgin Islands opposes both motions and challenges the propriety of the United States Attorney representing defendant.
