MEMORANDUM OPINION

I. INTRODUCTION
This matter is before the Court on Defendant’s Motion for Judgment as a Matter of Law or Alternatively for New Trial pursuant to Fed. R. Civ. R 50 and 591, respectively. Defendant, Merchants Market, Inc.,2 (“Defendant”) raises a number of issues in support of this Motion.
