THIS MATTER is before the Court on Defendant Paul Ramsden’s (hereinafter “Defendant” or “Ramsden”) Motion to Dismiss (hereinafter “Motion”), filed May 15, 2013. Plaintiffs Catherine P. Diaz (hereinafter “Catherine”) and Francis B. Diaz (hereinafter “Francis”) (collectively “Plaintiffs”) filed an opposition (hereinafter “Opposition”) on June 4, 2013.
