Before the Court are motions for summary judgment filed by Plaintiff United States Lighting Service (U.S. Lighting) and Defendant Underwriters Laboratories, Inc. (UL). For the reasons set forth below, both motions are denied. 1
FACTUAL BACKGROUND
On August 3, 1990, the Court denied motions to dismiss filed by the Llerrad Corporation (Llerrad) and UL. United States Lighting Service, Inc. v.
