Appellant, a sanitary district organized under an act of the General Assembly of May 17, 1907, (Hurd’s Stat. 1916, p. 1062,) filed its petition in the county court of St. Clair county to condemn certain property of the appellee railway company in that county for right .of way for the construction of a main channel connecting Prairie du Pont creek, at the eastern boundary line of the district, with what is known as the Cahokia chute of the Mississippi river, and the construction of a levee along the north line of said channel.
