The fundamental ground of this application is that while the bail was in force, the suit went to trial and resulted in a verdict for the defendant. On the other hand, it should be noted that the plaintiff immediately applied for and obtained a rule to show cause why the verdict should not be set aside and a new trial had, and that such rule is now pending.
